For ìlúEats riders.
You carry sealed food from a kitchen to a customer. Two things matter above all: the seal stays unbroken, and you get there safely. This agreement covers how you work with us, what you are responsible for, and what we are responsible for.
1. This agreement
This Rider Agreement is between ìlúEats and you, the rider. It takes effect when you are onboarded and continues while you accept deliveries through the Platform. The version at the top of this page is the current one, and we record which version you accepted.
2. Your status
You are an independent contractor, not an employee of ìlúEats. Nothing in this Agreement creates an employment, agency or partnership relationship.
You choose when to go online and which offered deliveries to accept, you provide your own vehicle, fuel, phone and data, and you are responsible for your own taxes and any statutory contributions.
You may not subcontract a delivery, or let anyone else use your rider account. Every delivery must be carried out by the person we onboarded.
3. Food handling and the seal
Never open, unseal, taste, remove from, add to, or otherwise interfere with a customer's order. You are carrying a sealed package prepared by someone else, and the integrity of that seal is the whole of the customer's assurance that nothing happened to their food in transit.
You must also:
- check at pickup that the package is sealed and undamaged, and refuse it and tell us if it is not;
- carry orders upright in a clean, closed insulated bag used for food only — never loose, and never alongside fuel, chemicals, cleaning products or anything else that could contaminate them;
- keep hot and cold items separated and insulated;
- keep your hands, bag and vehicle clean, and not handle food if you are unwell with a stomach illness or skin infection;
- not smoke while handling orders, and never leave an order unattended; and
- go directly from pickup to drop-off, without personal detours that add to the time the food is in transit.
Tampering with an order — including opening a sealed package for any reason — is grounds for immediate and permanent removal from the Platform, and we will report theft to the police.
4. Carrying out a delivery
Follow the delivery mode on the order: bring it to the door for a door delivery, or meet the customer at the selected landmark. Contact the customer if you cannot find them, and use the in-app flow to record a failed delivery rather than abandoning the order.
For age-restricted items, ask for proof of age and refuse the handover if it is not produced or the recipient appears intoxicated. Record the refusal in the app.
Complete each delivery in the app at the point of handover, so the customer's record and yours match.
4A. Babcock University campus — food deliveries
Never take food or any other edible item onto the Babcock University campus for a student resident there. ìlúEats delivers edible items inside Babcock to staff and to non-students only. Non-edible items are not restricted.
The customer confirms their status before they pay, and that confirmation is recorded. If it turns out to be wrong at the gate — the recipient is a student in a hall of residence, or security tells you the delivery is not permitted — refuse the delivery, do not enter the campus, do not argue with security, and leave. Record the refusal in the app and tell support. You are not penalised for a delivery refused on this basis, and you keep the delivery fee.
This clause exists for you. The university enforces its rules against the person it finds on its grounds, and that person would be you. No order is worth being detained over, and nobody at ìlúEats will ever ask you to go round it.
5. Road safety, vehicle and insurance
You warrant, on a continuing basis, that:
- you hold a valid driver's licence for the vehicle you use, and the vehicle is roadworthy, registered and lawfully on the road;
- you hold at least the third-party motor insurance the law requires, and will produce it on request;
- you wear a helmet where you ride a motorcycle, and require your pillion to do the same; and
- you comply with all road traffic law, and never ride under the influence of alcohol or drugs.
Do not use the app while riding. No delivery is worth an accident — if an order will be late, it will be late.
Report any accident, injury, theft or road incident occurring during a delivery to us as soon as it is safe to do so.
6. Conduct
Be courteous and professional with customers, vendors and our staff. Harassment, discrimination, threats, violence, and contacting a customer after a delivery for any reason unconnected with it are all grounds for removal.
Customer details are given to you for one delivery only. Do not save, share or use them for anything else, and delete anything you noted down once the delivery is complete.
You are equally entitled to be treated with respect. Report abuse from a customer or vendor and we will act on it.
7. Payments
Delivery earnings are calculated on the basis notified to you and paid on the agreed cycle. Where you collect cash on delivery, that cash is held by you on our behalf and must be remitted in full on the agreed schedule; shortfalls may be set off against your earnings.
8. Responsibility and indemnity
You are responsible for the order from the moment you take it until you hand it over. Loss, theft or damage caused by your handling — or a refund we owe a customer because of it — may be recovered from you.
You agree to indemnify ìlúEats against any claim, loss, fine or cost arising from your breach of this Agreement, from your driving or use of your vehicle, or from your interference with a customer's order.
We are not liable to you for indirect or consequential loss, and we do not exclude liability for death or personal injury caused by our own negligence, for fraud, or for anything else that cannot lawfully be excluded.
9. Suspension and termination
Either of us may end this Agreement at any time on written notice. We may suspend or remove you immediately where we reasonably believe there is a risk to a customer, a vendor or the public — including tampering, theft, riding under the influence, or an expired licence or insurance.
Clauses 6 and 8 survive termination.
10. Governing law
This Agreement is governed by the laws of the Federal Republic of Nigeria and is subject to the exclusive jurisdiction of the Nigerian courts.
